These Terms & Conditions (“Terms”) govern your access to and use of paisdfoundation.org (the “Site”) and the services, donations, events, and communications offered by the Port Aransas Education Foundation (“PAEF,” “the Foundation,” “we,” “us,” or “our”). By using the Site or participating in our programs, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Foundation
The Port Aransas Education Foundation is a Texas nonprofit organization established to raise and steward funds that create exceptional educational experiences for students in the Port Aransas Independent School District. Donations may be tax-deductible to the extent allowed by law; please consult your tax advisor and retain your receipt.
2. Eligibility
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to make a donation, register for an event, or otherwise transact on the Site. You represent that any information you provide is accurate and that you are authorized to use any payment method you supply.
3. Donations
- All donations are voluntary and, unless otherwise stated, are non-refundable. If you believe a donation was made in error, contact us promptly and we will review the request in good faith.
- Donations are processed by secure third-party payment processors. By donating, you authorize the applicable charge to your selected payment method.
- Recurring donations, if selected, will continue at the interval you choose until you cancel. You may cancel a recurring gift by contacting us.
- We will provide a receipt or acknowledgment for tax purposes as required by law.
4. Events, Tickets & Auctions
- Event registrations, ticket purchases, and auction participation are subject to any additional rules stated for the specific event.
- Unless otherwise stated, ticket purchases and winning auction bids are binding and non-refundable.
- Winning bidders are responsible for payment of the full bid amount and for arranging pickup or delivery of items as instructed.
- Item values and descriptions are provided in good faith; the Foundation makes no warranty regarding donated goods or services offered through an auction.
5. Text Messaging (SMS) Program
By opting in to the Port Aransas Education Foundation text messaging program, you agree to receive recurring SMS messages related to donations, events, mobile bidding, receipts, reminders, and Foundation updates from our dedicated toll-free number, operated with our fundraising provider, OneCause.
- Consent: Opt-in is optional and is not a condition of donating or purchasing. You opt in by texting a keyword, checking a consent box with your mobile number, or providing your number to us.
- Message frequency varies based on your activity.
- Cost: Message and data rates may apply. Charges are billed by your wireless carrier.
- Opt out: Reply STOP to our number at any time to unsubscribe. We will send a confirmation and stop sending messages.
- Help: Reply HELP to our number, or email portaransaseducationfoundation@gmail.com, for assistance.
- Carriers are not liable for delayed or undelivered messages.
- Both opt-in and opt-out for this program occur through the same dedicated toll-free number.
Your mobile information is handled in accordance with our Privacy Policy. No mobile opt-in data will be sold or shared with third parties or affiliates for marketing or promotional purposes.
6. Acceptable Use
You agree not to use the Site to: violate any law; infringe the rights of others; transmit harmful, fraudulent, or deceptive content; interfere with or disrupt the Site or its security; or attempt to gain unauthorized access to any system or data.
7. Intellectual Property
The Site and its content—including text, graphics, logos, and the Foundation name and marks—are owned by or licensed to PAEF and are protected by intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written permission, except for personal, non-commercial use.
8. Third-Party Services & Links
The Site uses and links to third-party services (such as payment processors and the OneCause fundraising and event platform) and other websites. We are not responsible for the content, products, or practices of third parties, and your use of their services is subject to their own terms and policies.
9. Disclaimers
The Site and services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, the Port Aransas Education Foundation and its directors, officers, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Site or services, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless the Foundation and its directors, officers, volunteers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising under these Terms will be resolved in the state or federal courts located in Texas.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated version on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
